Understanding the OPT Reporting Requirement
Students on F-1 visas who engage in Optional Practical Training (OPT) must actively maintain compliance with U.S. immigration laws. One of the most crucial responsibilities during OPT is reporting employment accurately and promptly.
A recent reminder from the Student and Exchange Visitor Program (SEVP) warns that failing to report employment may lead to severe consequences, including the termination of the student’s SEVIS (Student and Exchange Visitor Information System) record.
Why This Matters
The Department of Homeland Security uses the SEVIS database to track international students throughout their stay in the United States. During OPT, students are only allowed a total of 90 days of unemployment under federal regulation 8 CFR § 214.2(f)(10)(ii)(E).
If a student does not report their employment in SEVIS, each day without an update is treated as a day of unemployment. This means that even if the student is actively working, failure to report it can still result in accumulating unlawful unemployment days.
Consequences of Non-Compliance
Exceeding the 90-day unemployment limit or failing to report employment can lead to:
SEVP grants only 15 calendar days from the issuance of a compliance notice to resolve any reporting issues. If the record is not corrected in that time, termination becomes official.
